Read the information presented in the Learning Activity titled “Definition of Tort.” According to the reading, the three types of Torts are intentional torts, negligent torts, or strict liability torts. 1. Using examples from the reading, describe the difference between a tort and a crime. The law does not remedy all “wrongs.” However, the tort does not reveal the underlying principles that divide wrongs in the legal sphere from those in the moral sphere. Calling someone a name and hurting someone's feeling is not covered in criminal action per se, but if these have to lead to damage, it can be covered civilly with Tort law. The law of torts developed almost entirely in the common-law courts; that is, statutes passed by legislatures were not the source of tort law (as they are for criminal law). Usually, plaintiffs would rely on the common law (judicial decisions). However, tort law has fashioned a series of rules that govern the conduct of individuals in their noncontractual dealings with each other through thousands of cases. A crime is an act against the people as a whole. Tort law views the death as a private wrong for which damages are owed. In a civil case, the tort victim or his family, not the state, bring the action. 2. According to the reading, why should employers be aware of these types of legal claims? According to the reading employers should be aware of the tort because, in many circumstances, their employees may create liability in tort. 3. choose one example of tort from the reading and explain why a plaintiff might receive monetary compensation for their injury. Intentional torts result from intentional acts, whereas unintentional torts arise from carelessness (e.g., when a surgical team fails to remove a clamp from a patient’s abdomen). In strict liability torts, there may be no fault at all, but tort law will sometimes require a defendant to make up for the victim’s losses even where the defendant was not careless and did not intend to harm. Liability torts are often the type used in auto accidents. A patient is due to something when they are injured as a result of carelessness. Further, carelessness on the highway brings the question of shared responsibility, at what percentage is each person at fault, and why. Tort law solves such issues and awards damages. 4. Provide another example from the reading of when someone might be awarded punitive damages. In certain instances, the courts will permit an award of punitive damages, sometimes called exemplary damages, is awarded when a defendant has deliberately committed a wrong with malicious intent or has otherwise done something outrageous. An example might be a hacker attacking an individuals bank accounts for reasons of revenge. Once caught such a malicious act might be awarded punitive damages.
